How did MOHELA take over my loan from the US Department of Education? I have a student loan from the US Department of Education. (Direct Loans) My loan is paid on-time, every month, and in good standing. I received a letter in the mail today from MOHELA claiming that they have taken over my student loan and I should start paying them. Here is what they claim in the direct mail they sent me: WHY WE ARE CONTACTING YOU: Effective 11/10/11, your federally-owned student loan account, previously serviced by the Direct Loan Servicing Center, is now being serviced by MOHELA, Department of Education Servicer. MOHELA is honored to be selected as your servicer and we look forward to providing you with excellent service. --End of quote-- MOHELA's address: 633 Spirit Drive., Chesterfield, MO. 63005 I have never contacted MOHELA for any reason. I went to school in California. I am from California. I have never even been to Missouri in my life. How could they have possibly got ahold of my loan? My loan is not past due, and has always been paid on time. I have never attempted to consolidate my loan, or change it to a loan servicing center. Is it legal for them to just suddenly take over my loan? Is this a scam? I have never contacted MOHELA in my life, I still have not contacted them. I just received this letter in the mail out of the blue. Is this legal? Should I contact the Better Business Bureau and file a complaint? Can I sue them for harassment?
Can I consolidate all my student loans listed at NSLDS? My NSLDS account (http://www.nslds.ed.gov ) lists several student loans I have, both direct and non-direct, subsidized and unsubsidized. Now the government's Direct Consolidation Loans (http://www.loanconsolidation.ed.gov/ ) claims I can consolidate "U.S. Department of Education Direct Loans, U.S. Department of Education non-Direct Loans, Perkins, and Federal Family Education Loans". Does this basically mean I can consolidate ALL the loans I have listed at NSLDS? I'm assuming all my loans listed on the NSLDS are government loans, either direct or non-direct, right?

Should i pay the interest on my student loans starting now? I got this letter from direct loans, the u.s department of education telling me i have a balance of about 72 on interest on my student loans. should i pay this off right now or wait until i graduate? Mohela took over my loan from the Department of Education and claimed it could change the terms? I got a notice a few months ago that Mohela was taking over my student loan from the Direct Loan Servicing Center and several payments have been made with auto-debit to Mohela at the correct amount of $1289.78. The loan was consolidated under a single loan about 10 years ago with a 30 year term and with a fixed interest rate of 4.95% (with the .25% deduction of the auto debit included). I have all the documentation to prove it and I am sure Direct Loan Servicing Center provided Mohela with this information. I receive a letter yesterday raising my monthly payments to ~$11,057 a month and stating it was due to "Your terms have been re-calculated to maintain federal/program guidelines". Obviously, the new terms were not agreed upon by me and I can not afford this unbelievably high payment. I would like Mohela (loan previously with Direct Loan Servicing Center) to address this and return to the agreed upon monthly withdrawal of $1289.78 at the 4.95% interest rate for both loans combined as per the terms/disclosure and condition sheet that I possess demo Direct Loan Servicing Center. I do not understand why the change in the monthly payment amount without us requesting it since it was agreed upon already on a signed document between myself and Direct Loan Servicing Center. This breach of terms is not only improper but unethical and frankly not the right way to do business. If it is in error then they should have better quality (document) control. What is going on??? Contacted Mohela today and at first they were adamant that I was wrong and they could not have made a mistake. But I was not going to let this go so I told them I had documentation and they were definitely off on this for sure. I read the representative the info from my disclosure statement from Direct Loan Servicing and let them know the loan matured in 2031 not 2013 as their most recent letter stated. It looked like someone had switched the last two digits. After about an hour on the phone and going thorough a supervisor at Mohela they came back and said their was an error on their side. I asked "who made the error, Mohela or Direct Loan Servicing" the representative said she didn't know because her supervisor just gave her the info regarding the mistake and not who made it. If I hadn't pushed for a resolution then I would have walked away with a payment which was ~10x the original. In any case, they said it would be reflected on my account in 48 hours and my My maturity date will return to 2031. Lets see what happens. By the way, they said they never heard of you Will (Shaffner).
My student loans are now being serviced by Sallie Mae? I just logged in to the direct loan servicing website to pre pay my student loans for the next few months and I now have a $0 balance with this message: Our records indicate that Account(s) *****s no longer being serviced by us. This account is now being serviced by: Sallie Mae - Department of Education Loan Services. Uhhhmmmmmm WHAT? Why did this happen? My account was current! Idk what to do does this mean all my repayment terms have changed? Has the DLS consolidated all my loans with my other Sallie Mae loans without my permission? I'm trying to get an answer from both companies but its always a wait to talk to a rep and im on hold now. omg. still holding. I previously owed Sallie Mae and the Federal Direct Loans programs about 10 G each. Now the FDL says I owe them 0, and sallie mae is only giving me a total of about 13g. This is a mess. Credit Score and Mortgage Situation..? My husband and I were looking into buying our first home with the intentions of obtaining a FHA loan. However, after doing some research a couple months back, I discovered that my husband had a terrible credit score of 547. The $11,170 student loan that his father was court ordered to pay during the divorce was more than 90 days late on 9 separate occasions. His father never told us that he wasn't paying this loan, and since he was in charge of it, the only contact information they had was his father's and his mother's/his home address (with whom he doesn't talk to). After talking to a mortgage loan specialist, we realized there would be no one that would approve us for a mortgage even given the circumstance. So some friends of mine graciously said that they will give us a place to stay so we can financially focus our money on working off his student loans. So my first question is, if we put more than $2,000 a month down on his loans, how long would it take before his credit score began to rise? Also, my husband threatened to take him to court for violating the court order where his father then said that he would only be able to get a $5,000 loan out to cover the costs. My second question is if we contacted the US Department of Education/Direct Loan (loan lender) and told them the situation, that we had $5,000 to put down on it, and that we could send a copy of the court order, would they remove most of the bad credit with the loan? If someone could please give us some answers and insight into what we could do I would so very much appreciate it. Can my school change my federal unsubsidized loans without my permission? My school originally awarded me 2 federal direct unsubsidized loans. One was for 6219 per semester The other was for 5970 per semester I also received the maximum of 8500 for subsidized loans. I have received official documents from the Department of Education Loan Services and the US Department of Education for all of the aforementioned amounts. My school decided to then reverse these loans and then issue me a new one for 5028 per semester. I have NO previous student debt at all or any debt for that matter. My credit score is an 812 out of 830. I have NEVER been financially irresponsible. I did NOT submit any requests, either verbally or written, to modify my loans. I am receiving a scholarship for 36000 this year (total) to help with living expenses. The total estimated cost to go to my school, with tuition, books, fees, transportation, food, health care (which is mandated), etc. is over 65000. With the original amounts, I would have been above the federal poverty line. With the new modified amounts, I will not be able to afford rent or basic needs as it will leave me with 14000 for the remainder of the year to cover all extraneous expenses such as housing, food, clothing, utilities, transportation to and from school, etc. It is cheaper to live off campus than to live on campus, which I do live off campus. The maximum for subsidized loans EACH year for a graduate student is 8500. The maximum for unsubsidized loans EACH year for a graduate student is 20, 500. So therefore, I do not breach these rules and regulations and limits. I completed all of the counseling, applications, entrance, etc. in early April of 2011 (this year). How long does certification process take for a student loan? My financial aid was just sent to the DOE Direct Loan for certification for a stafford graduate loan. My Master Promissory Note and everything has been signed and done. I'm just now waiting for the "certification" process. I'm not a first time borrower so I'm assuming it should be relatively quick. How do i get the US Department of Education to accept my Americorp Voucher? I have a loan of now 2,800 dollars from direct loans and I keep mailing them the form filled out with the whole payment. They do not accept the online payment thru Americorp nor will they fax anything back to Americorp. Ive mailed the correct form over 6 times. I even payed for signature confirmation to ensure that they recieve the voucher form.The US Dept. of Edu. said they mailed the filled out voucher to Americorp on Feb 16. Americorp states they havnt received anything from them. Americorp gives me their fax num, allows me to do online payment requests but the problem is the US Dept of Edu JUST tells me ' oh well we mailed it out on Feb theres nothing else we can do'. They wont fax anything to Americorp, they wont allow any other confirmation of mailing out the voucher to Americorp, nor will they mail it back to me so i can pay for a signature confirmation from Americorp. What agency or who can i contact if the US Dept keeps giving me the run around about ensuring that they get payed through Americorp? Im at my wits end with calls back and forth and the US Dept just saying we sent it through reg mail we cant do anything else. Please help, at my earnings i cant afford to give payments every month and id rather just use my Americorp Segal Award to pay off my loan entirely.
What are some reputable companies to consolidate private student loans? My attorney told me that in order to consolidate my private student loans to be sure that I used a federally approved company or one that had the stamp of approval of the Department of Education. I can't really find any information, and I'm not looking for a shady company obviously. I have found a few like Wells Fargo, but have read that those loans are actually a scam. My school says I have out 16,000 in student loans but my lender says I only owe 9,000...... Who to beleive? I was in the financial aid office today discussing some things and my adviser tells me I have out 16,000 in student loans! I KNOW i did not take out that much and only have about 10,000 in loans. So when I got home I called my lender and they said I only have out 9,000 in loans. I ever called the department of education number to be sure I dident have loans out with any other lender. I only have loans out with the one lender Direct Loans. So why is my school telling me I owe 16,000 when my lender is saying I only owe 9,000? The lender says to go by what they say since they are the ones I'll be paying back but I'm just baffled as to why the school is saying i owe so much more in loans. Could this cause problems down the road? I don't want to be paying back more money than i borrowed.... or should i just go by what the lender is telling me? WE NEED A BAILOUT FOR COLLEGE GRADUATES? If homeowners are getting bailout in terms of loan restructing in regards to FHA. Then so should college student in regards to private loans. People talk about how corrupt Walll street was in regards to home loans. Let's talk about corruption in regards to Private Student Loans. Department of Education through DIRECT, should take the initiative in consolidating private student loans. I am not neccessary asking for a bailout, however similiar through FHA, restructing of Private Student Loans, where they can have same benefits of Direct Loans. The reality as unemployment increases, the odds of default will rise, however a program though Direct allowing private loans to be consolidated with a fixed interest rate will be beneficial towards to the economy.

The Direct Loan Program provides more certainty during this transitional period since it is administered and funded by U.S. Department of Education. To be ready for Direct Loan, all you have to do besides completing your FAFSA is: 1. Complete a Master Promissory Note (MPN), and 2. Complete an Entrance Counseling session. Because I'm trying to get into college but I can't do that if their is no financial aid for us. Here is what he said. Does this reply mean that my parent qualified for the PLUS loan? Serious answers only please... I know it's long, so thanks to anyone who can bear with me. I'm a US student going overseas to study at university in the UK. The university I am attending offers student loans of $5500 if you have a low EFC and are a dependent student, but says that if your parent doesn't qualify for a parent PLUS loan then you can apply as an independent student to receive $9500. I wanted to qualify for the full $9500 loan, so I asked my mom to apply for the parent PLUS loan assuming that she wouldn't get accepted because as far as we know, both she and my dad have always had terrible credit and my mom is currently unemployed. Well, she applied for the PLUS loan, and after entering her information and agreeing to a credit check there came this reply (to all intents and purposes, my mom will now be christened BLABLA): Dear BLABLA, You are approved to borrow a Direct PLUS Loan, pending the receipt of additional loan records from the school you or the student attends. This determination is based on the results of a credit check with: EQUIFAX INFO SERVICES LLC P O BOX 740241 ATLANTA GA 30374 (800)685-1111 The pending loan records must be received within the next 90 days. If the loan records are received more than 90 days after the initial credit check, a new credit check will be conducted to determine your continued eligibility. If you have questions regarding the next steps, the status of your loan, when the loan will be disbursed (paid out), or no longer wish to receive the loan, contact the school's financial aid office. After the first disbursement of your loan has been made, your loan will be assigned to a loan servicer and you will be provided with the servicer’s name, address and contact information. Someone please help me understand this....? I feel really stupid because for some reason I can't figure out if I will receive my aid in time before my classes start, even though it seems to be spelled out very simply. I am enrolled in an online program through my local community college, my classes start 24 hours a day, 7 days a week, all year. You get to select your own start date for each class, and payment for the class is due the day before it starts. My classes start on Oct. 26th, I have a pending grant and direct loans that I will accept Monday. Here is my program's disbursement policy- Learn on Demand has two 8 Week Payment Periods for grants. The payment period starts on the start date of the student’s first scheduled module. The grant payments are credited to student’s account in the 7th week of each 8 week payment period. These funds will be disbursed to the student’s account depending on the number of credit hours enrolled or intent to enroll into for the payment period and/or academic year. PELL, SEOG, ACG, CAP and KEES will be credited to student’s account in the 7th week of the 8 week payment period. Student must be enrolled for half-time (6 credit hours) or greater to qualify for Federal Direct Subsidized and Unsubsidized Loans. Students will receive one loan payment per term. Loans will not be certified until student reaches at least half-time (6 credit hours) enrollment and started their first course. At that point, the loan funds will be requested for release from the Department of Education. Will I receive my grant and loan money in time to pay for my classes? How to cancel a U.S. Student Loan? I'm trying to cancel a loan. Since I will not be attending school this year or that university I wanted to know if there is some contact information to call. Who asked this question (hands down, one of the worlds longest questions)? Let me, if I could, go to the Civil Rights Restoration Act. In 1981, you support an effort by the Department of Education to reverse 17 years of civil right protections at colleges and universities that receive federal funds. Under the new regulations, the definition of federal assistance to colleges and universities would be narrow to exclude certain types of student loans and grants so that fewer institutions would be covered by the civil rights laws. As a result, more colleges and universities would legally be able to discriminate against people of color, women and the disabled. Your efforts to narrow the protection of the civil rights laws did not stop there, however. In 1984, in Grove City v. Bell, the Supreme Court decided, contrary to the Department of Education regulation that you supported, that student loans and grants did indeed constitute federal assistance to colleges for purposes of triggering civil rights protections. But, in a surprising twist, the court concluded that the nondiscrimination laws were intended to apply only to the specific program receiving the funds and not to the institution as a whole. Under that reasoning, a university that received federal aid in the form of tuition could not discriminate in admissions but was free to discriminate in athletics, housing, faculty hiring and any other programs that did not receive the direct funds. If the admissions office didn't discriminate, they got the funds through the admission office, they could discriminate in any other place of the university. A strong bipartisan majority in both the House and the Senate decided to pass another law, the Civil Rights Restoration Act, to make it clear that they intended to prohibit discrimination in all programs and activities of a university that received federal assistance. You vehemently opposed the Civil Rights Restoration Act. Even after the Grove City court found otherwise, you still believed that there was, quote -- and this is your quote -- a good deal of intuitive appeal to the argument that federal loans and grants to students should not be viewed as federal financial assistance to the university. You realize, of course, that these loans and grants to the students were paid to the university as tuition. Makes supplemental appropriations available to the Department of Education for: (1) education of the disadvantaged; (2) impact aid; (3) school improvement programs; (4) innovation and improvement activities; (5) special education; (6) rehabilitation services and disability research; (7) certain student financial assistance programs, as well as federal administrative expenses for such programs; (8) teacher quality partnership grants; (9) the Institute of Education Sciences; and (10) school modernization, renovation, and repair. How long does an account have to be past due before it goes on my credit report? I'm so mad right now. The stupid department of education has sold and transfered my loans about 4 times in the past year, 2 of which have occured in just a couple months. I no sooner set up direct ACH payments than they transferred it again. I did not get this in the mail till just now and I looked at the new website where my account is and it says my account is 17 days past due and Deliquent!! I'm so pissed off. My credit score is 750 at 22 years old. I'm about to have a serious cow here. Will it say "late" on my credit report?? Or is there a grace period before it is branded on there? I just paid the ammount due (2 payments) and it will be applied to my account, and if their system is not laying it should be no more than 20 days past due. Should I just call them? I'm stressed cause it's Sunday and I'm just now finding this crap out.
Last one... student loan interest deduction - can I claim it? I've had some student loans sitting for a while now, and finally will qualify for a program that will allow me to clear it as "paid," to the department of education, yet I will repay the financial company for the loan instead. It is so I can start borrowing student aid again. If the financial pays the loan (including the interest), and it appears on my behalf as "paid," can I use that interest payment that the financial agency paid on my behalf, or would I have had to make a "direct payment" on that interest? This is a good one.
Student loan Consolidation? I applied for student loan consildation. I am due to start paying these back in Feb.2011.. I still haven't heard anything from the department of education. I called them today but it's Sunday so understandably they are closed. The automated message states they received my application on 12/6 and have sent me a letter stating I am in "Summary Statement Phase?" I have not received any letters. Legislation that would give permanent US residency to the children of undocumented workers if they complete two years of college or military service would cut the federal deficit by $1.4 billion over 10 years, according to a new government report. Can anyone give me some serious help with student loan consolidation questions? I am drowning! I have four loans that I'm currently paying off and am trying to find a way to consolidate them. One through American Education Services, one is a federal direct loan owned by the US Department of Education, and the last two are through Rhode Island Student Loan Authority. I tried to consolidate with loanconsolidation.ed.gov but they would only recombine the two parts of the one federal direct loan, despite the fact that the RISLA people are the ones who sent me to them! Regardless. I have spent the last few hours making myself crazy looking through consolidation websites and I could really use some help. The name of a reliable credible and helpful consolidation campany would be amazing as well as any tips from someone who has been here. The only name I've gotten so far was Chase and they have temporarily suspsended their consolidation programs. Please help! Credit Score and Mortgage Situation..? My husband and I were looking into buying our first home with the intentions of obtaining a FHA loan. However, after doing some research a couple months back, I discovered that my husband had a terrible credit score of 547. The $11,170 student loan that his father was court ordered to pay during the divorce was more than 90 days late on 9 separate occasions. His father never told us that he wasn't paying this loan, and since he was in charge of it, the only contact information they had was his father's and his mother's/his home address (with whom he doesn't talk to). After talking to a mortgage loan specialist, we realized there would be no one that would approve us for a mortgage even given the circumstance. So some friends of mine graciously said that they will give us a place to stay so we can financially focus our money on working off his student loans. So my first question is, if we put more than $2,000 a month down on his loans, how long would it take before his credit score began to rise? Also, my husband threatened to take him to court for violating the court order where his father then said that he would only be able to get a $5,000 loan out to cover the costs. My second question is if we contacted the US Department of Education/Direct Loan (loan lender) and told them the situation, that we had $5,000 to put down on it, and that we could send a copy of the court order, would they remove most of the bad credit with the loan? If someone could please give us some answers and insight into what we could do I would so very much appreciate it. This whole situation has put such a strain on our marriage and I don't know what to do at this point.

The American Dream turns into a debtor's nightmare A sad, but common, tale starts with alleged predatory lending, intensifies with impossibly high payments and usually ends in foreclosure. By Jennifer Delson and and Christopher Goffard, Los Angeles Times Staff Writers October 8, 2007 Soledad Aviles dreamed for years of owning a home, with a plot of land where he could grow corn and chiles as he did in his native Mexico. So he felt blessed last year when he learned he could buy a three-bedroom, single-story stucco house on West La Verne Avenue in Santa Ana. Referred to a local loan broker by a trusted friend, he borrowed the entire purchase price of $615,000 from Washington Mutual at a high interest rate typical of sub-prime loans. The monthly payment, as he says he understood it, would be $3,600 -- steep for a glass cutter who made $9 an hour -- but Aviles counted on his wife and three of his six daughters, who also worked low-paying jobs, to contribute. "We took out our pencils, figured out our take-home pay and figured out that if we all pitched in, it would work," said Aviles, 54, a stoop-shouldered, soft-spoken man with a sixth-grade education from Mexico. Relying on the broker's word, he signed loan documents written in English, a language he neither speaks nor reads, Aviles said. He was shocked to learn afterward that the monthly payment would not be $3,600, but $4,800 -- a price that forced him to rent out bedrooms, the garage and an enclosed porch while he and his wife slept on the couch. He fed his family with food from friends and corn he grew. Aviles says he was not aware that the February 2006 loan application he signed dramatically exaggerated his family's income. The application lists him as the owner of a landscaping business with a $7,400 monthly income. His 27-year-old daughter Marlene, who earns $9 an hour in a noodle factory, appears as the owner of a housecleaning company who makes $5,700 a month. The application lists their yearly income as $157,000, when, according to Aviles, it was really closer to $60,000. Now, five months behind on his payments, Aviles is scrambling to sell the house before the bank forecloses. Desperately ill from kidney disease and unable to work for the last year, he sits dejectedly at the dining room table, wondering when the bank will kick him out. Aviles' situation is hardly unique. Add his name to the ever-expanding list of casualties in the nationwide sub-prime mortgage debacle, his experience echoing that of thousands who bought homes in recent years only to find themselves in a sagging market saddled with payments they cannot make. But amid the storm of foreclosures, his story illustrates the special vulnerabilities of first-generation immigrants in places like predominantly Latino Santa Ana, where city leaders have identified about 800 sub-prime borrowers facing the potential loss of their homes. "We think this is just the tip of the iceberg, in terms of the breadth and depth," said Steve Harding, Santa Ana's deputy city manager. Apart from the language barrier, he said, many first-generation immigrants might have been especially vulnerable to sub-prime lending because they avoided checking accounts and credit cards, which prevented them from qualifying for regular loans. The city has teamed with the Fair Housing Council of Orange County to offer free foreclosure prevention workshops, hoping to teach people to avoid predatory lenders and find help as they face the loss of their homes. The Fair Housing Council said the number of people seeking help over mortgage woes, many of them Latinos living in Anaheim and Santa Ana, has soared. The group typically receives 15 to 20 complaints annually, but in September of this year the group received more than 20. The state Department of Real Estate, nonprofits and the Mexican consulate also have reported a rise in mortgage complaints, many of them from homeowners saying they signed documents they didn't understand. Across the state, many cases are landing in court. Kerstin Arusha, a directing attorney at the nonprofit Law Foundation of Silicon Valley, said that Spanish speakers, along with the elderly, "seem to be hardest hit by both sub-prime lending and predatory lending. There are many borrowers out there that were misled about the terms of the loan." The Law Foundation is suing a broker, real estate agent and lender in federal court on behalf of nine Santa Clara County families, many of whom speak only Spanish, contending they were lured into mortgages they didn't understand. The lawsuit alleges that the broker inflated incomes on loan applications, misrepresented the terms of the loans and stuck clients with higher payments than they had been promised. The victims "thought they saw the promise of the American Dream, and instead they ended up with a nightmare," Arusha said. "I think they were seen as easy targets for predatory lenders who could sell them a bill of goods without giving them disclosures in a language they understand." The Law Foundation is handling 10 other cases involving predatory lending, half of them for Latino clients, Arusha said. But in Orange County, the district attorney's office has not reported an increase in prosecutions for fraudulent lending. Elizabeth Henderson, a prosecutor in the county's fraud unit, said many such crimes go unreported in immigrant communities because of a distrust of law enforcement and confusion over what had occurred. "They're not really sure what they were promised, so they don't know if they were cheated," she said. Sitting in his Santa Ana home, waiting for the bank to kick him out or for his kidney to kill him, Aviles did not hesitate to characterize what had happened to him: "They used me, nothing more." He was led astray, he said, by a man he had considered a dear friend, Carlos Lares. They used to work in a factory together. He said Lares showed him about a dozen homes, including the one he bought, and offered to arrange a mortgage. State records show Lares lacks the real estate license required to show homes. In an interview with The Times, Lares denied showing homes and said he merely took Aviles to the office where he works, Century 21 South Coast. He declined to comment further. His business card lists him as a "team service associate." That means that there are 1,080,000 unemployed Americans who are exactly the ones against whom the illegal alien competes for those same jobs. Forty percent of working-age African-American men are unemployed. - BLS 78.4 percent of the 24 million workers in service jobs are native-born Americans. -BLS 78.4% of 24 million = 18,816,000. Subtract that number from 24 million workers in service jobs and you get 5,184,000. Over 5 million service jobs held by non Americans. I have to believe that there must be some unemployed Americans who would be willing and able to work some of those jobs.
