CAN MY PRIVATE CHASE STUDENT LOAN BE DISCHARGED UPONC BANKRUPTCY?
WHAT IS THE TRUTH CAN IT BE DISCHARGED OR NOT>>>?? I NEED AN ANSWER I FILED BANKRUPTCY AND MY LAWYER SAID NO BUT THEN I READ ABOUT IT ELSEWHERE AND THEY SAY YES IT CAN SO I DONT KNOW IF MY LAYWER JUST DOESNT CARE OR WHAT ITS NOT A GOVT LOAN IS A PRIVATE LOAN

- Student loans can't be discharged with bankruptcy.
- In 99.999% of all cases it cannot. Yes it is a private loan, but the same rules apply as a gov't loan. They are treated the same way because if not, students can just claim bankruptcy and basically get a free college education. In order to be one of those .001% who do get it discharged, you MUST show some reason why your case is SOOOO very different than everyone one else and possibly show that fraud was involved.
- The only way student loans can be discharged in bankruptcy is if repaying them would create an undue hardship on you or your family. That means you could not maintain a minimum standard of living. There have been cases where judges have discharged part of the loan if repaying it all would mean "undue hardship". But this is very, very difficult to pull off.
- Your debt........pay it........don't expect the taxpayers to cover you expenses.........it cannot be discharged.......and that's a good thing..... Don't use caps its rude......but you know about that.....
