How far behind do you have to be on a Sallie Mae student loan for them to take your tax return?

I am 3-4 months behind and have tried to pay them within the past month several times. Sallie Mae tells me my loan has been sold to the Department of Education and the Department of Education tells me they have no account info on me. I am wondering if they try to do this on purpose so they can take your entire tax return. I have also updated my phone # with them and have not gotten any collection calls from either....????
